General Terms and Conditions (GTC)


1 Scope of application

These General Terms and Conditions apply to all contracts for deliveries and other services.

2 Conclusion of the contract

The following provisions on the conclusion of a contract apply to orders placed via our online shop http://www.jollyknits.com, http://www.jollyknits.ch, http:// www.jollyknits.de.

Upon conclusion of the contract, the contract is concluded with:

The presentation of the goods in our Internet shop does not constitute a legally binding contractual offer on our part, but is merely a non-binding invitation to the buyer to order goods. By ordering the desired goods, the buyer submits a binding offer to conclude a purchase contract.

Upon receipt of an order in our Internet shop, the following regulations apply: The customer submits a binding contractual offer by successfully completing the order procedure provided in our online shop.

The order is placed in the following steps:

1) Selection of the desired goods
2) Confirm by clicking on the "Add to shopping basket" button
3) Check the details in the shopping basket
4) Click on the "Proceed to checkout" button
5) Log in to the online shop after registering and entering the login details (e-mail address and password).
6) Re-check or correct the data entered.
7) Read and accept our Terms and Conditions 
8) Binding dispatch of the order by clicking on the "Buy" button

Before submitting the binding order, the buyer can return to the website on which the buyer's details are recorded and correct input errors or cancel the order process by closing the Internet browser by pressing the "Back" button contained in the Internet browser used by him after checking his details. We confirm receipt of the order immediately by means of an automatically generated e-mail ("order confirmation"). With this we accept the offer of the buyer.

Storage of the contract text for orders placed via our online shop: We save the text of the contract and send the order data to the buyer by e-mail. The General Terms and Conditions can be viewed at any time in the online shop under "General Terms and Conditions". An order history can be viewed in our customer area under My account --> History and details of your orders.

3 Digital products

Delivery

All knitting patterns offered in the online shop are available as digital PDF files. Once your purchase has been completed, you will receive a confirmation email containing a download link. The PDF file(s) can be downloaded immediately. They are also stored in your customer account and can be downloaded again at any time. No printed patterns will be sent by post.

Private Use

All knitting patterns are protected by copyright and are subject to Swiss copyright law. The copyright to the patterns and their design belongs to Jollyknits –  Jolanda Schneider.

The knitting patterns are intended exclusively for private, personal use. Sharing them with third parties—whether as printed copies or PDF files—is prohibited. The patterns, in whole or in part, may not be copied, reproduced, distributed, or published. This also applies to all texts, images, and graphics contained therein.

Items knitted using these patterns may be given as gifts but may not be sold or otherwise used for commercial or business purposes.

Commercial Use

Any commercial or business use of the knitting patterns is expressly prohibited. This applies both to the patterns themselves and to all items made using these patterns.

In particular, it is not permitted to offer or sell individual items or production runs made from these patterns for payment. Furthermore, the patterns may not be used for commercial classes, workshops, training courses, sales events, or any other activities that generate income directly or indirectly.

Modified, adapted, or expanded versions of the patterns may also not be used commercially, published, distributed, or sold.

Storage of the files

  1. Creating a backup: The purchaser is responsible for saving the PDF files received or downloaded immediately after purchase and creating a backup copy on another storage device to prevent data loss.

  2. Notice regarding loss: Please note that if the PDF files are lost, the pattern must be purchased again. It is the purchaser's responsibility to take appropriate measures to back up the files and prevent such a loss.

  3. By accepting the Terms and Conditions when purchasing a pattern, you confirm that you have read these policies and agree to them in full.

  4. Digital products are excluded from exchange or refund. 

4 Disclaimer

All instructions are carefully created, checked and test knitted by us. However, we accept no liability for deviating knitting results. As every person knits differently, uses different needle sizes or even knits the pattern with different yarns, we cannot accept any liability or guarantee. Thank you for your understanding.

5 Prices

Prices are quoted in CHF, EUR and USD. The exchange rate conversion is updated regularly. Due to our small business status, we do not charge VAT and do not show it.

6 Terms of payment

Unless otherwise agreed in writing, payments must be made in advance via PayPal or credit card. TWINT is also offered for Swiss customers only. Bank transfers are not possible.

7 Retention of title

We reserve title to the goods until the purchase price has been paid in full.

8 Offer details

All quotation details (illustrations, dimensions and all other technical details) on our online shop are provided without guarantee. We reserve the right to make changes at any time.

9 Dispatch

Download products are delivered immediately after payment via download link.
No instructions are sent by post.

10 Rright of return

With immediate access to the digital content, no right of cancellation can be asserted as soon as the download of the digital content is started. 

11 Place of fulfilment / applicable law / place of jurisdiction

The place of fulfilment for deliveries / services is Winterthur CH. Swiss law shall apply to all disputes between the contractual partner and Jollyknits. The place of jurisdiction is Winterthur Switzerland.

12 Amendments

We reserve the right to amend these GTC at any time and without prior notice.
