1 Scope of application
These General Terms and Conditions apply to all contracts for deliveries and other services.
2 Conclusion of the contract
The following provisions on the conclusion of a contract apply to orders placed via our online store http://www.jollyknits.com, http://www.jollyknits.ch, http:// www.jollyknits.de.

The presentation of the goods in our Internet store does not constitute a legally binding contractual offer on our part, but is merely a non-binding invitation to the buyer to order goods. By ordering the desired goods, the buyer makes a binding offer to conclude a purchase contract.
Upon receipt of an order in our Internet store, the following regulations apply: The customer submits a binding contractual offer by successfully completing the order procedure provided in our online store.
The order is placed in the following steps:
1) Select the desired goods
2) Confirm by clicking on the "Add to shopping cart" button
3) Check the details in the shopping cart
4) Click on the "Proceed to checkout" button
5) Log in to the online store after registering and entering the login details (e-mail address and password).
6) Re-check or correct the respective data entered.
7) Binding submission of the order by clicking on the "Buy" button
Before submitting the binding order, the buyer can return to the website on which the buyer's details are recorded and correct input errors or cancel the order process by closing the Internet browser by pressing the "Back" button contained in the Internet browser used by him after checking his details. We confirm receipt of the order immediately by means of an automatically generated e-mail ("order confirmation"). With this we accept the offer of the buyer.
Storage of the contract text for orders placed via our online store: We save the text of the contract and send the order data to the buyer by e-mail. The General Terms and Conditions can be viewed at any time in the online store under "General Terms and Conditions". An order history can be viewed in our customer area under My account --> History and details of your orders.
3 Digital products
All instructions offered in the internet store are subject to Swiss copyright law. Copyright instructions/design by Jollyknits - Jolanda Schneider.
The instructions are for private and personal use only. It is forbidden to pass them on to third parties as printouts or electronic files. Likewise, instructions may not be copied, reproduced or published. The sale of the instructions, the texts, images or graphics contained therein and their use for commercial purposes is prohibited. Re-knitted models may be given as gifts, but may not be re-knitted for commercial purposes from which financial proceeds are generated.
We ask the buyer to save the PDF files sent or downloaded in such a way that they are still available on another storage medium if they are lost. In exceptional cases, we can resend the lost files. However, we would like to point out that in the event of a further loss, the instructions must be purchased again.
Digital products cannot be exchanged or returned.
4 Disclaimer
All instructions are carefully created, checked and test knitted by us. However, we accept no liability for deviating knitting results. As every person knits differently, uses different needle sizes or even knits the pattern with different yarns, we cannot accept any liability or guarantee. Thank you for your understanding.
5 Prices
Prices are quoted in CHF, EUR and USD. The exchange rate conversion is updated regularly. Due to our small business status, we do not charge VAT and do not show it.
Prices are quoted from our warehouse in Winterthur CH, excluding shipping costs. Our prices and shipping costs are subject to change. We reserve the right to change them without prior notice.
6 Customs and import duties
Our goods are shipped from a non-EU country (Switzerland) to an EU country or internationally. The amount of customs duties and import VAT payable is determined by the country of destination and upon import. Therefore, these goods may be subject to customs duties and/or import sales tax which will be additionally charged to the buyer. Import VAT is calculated at the VAT rate applicable in the country to which the goods are delivered.
Customs duties may not be charged for goods whose value is less than the threshold value of the destination country. For more accurate and correct information, please contact the customs office in your country.
Please note that Jollyknits is NOT responsible for the collection or assessment of customs duties or import VAT and cannot accept any liability for this.
7 Terms of payment
Unless otherwise agreed in writing, payments must be made in advance by bank transfer, PayPal, PostFinance or credit card.
8 Retention of title
We reserve title to the goods until the purchase price has been paid in full.
9 Offer details
All quotation details (illustrations, dimensions and all other technical details) on our online store are provided without guarantee. We reserve the right to make changes at any time.
10 Shipping
We deliver within Switzerland, Europe and worldwide.
Download products are delivered immediately after payment via download link.
Our wool is shipped immediately after receipt of payment.
All parcels up to 1 kg are sent with Swiss Post Priority Shipping. The shipping time for these parcels is 3 - 5 working days for Europe. For worldwide 5 - 10 working days. This information is based on information from Swiss Post. As various shipping providers and the customs office are involved in the process, delays may unfortunately occur.
Swiss Post Priority shipping service with tracking number. The parcel can be tracked at any time. All parcels are insured in the event of loss or damage.
11 Right of return
Due to the complex individual production of the articles offered, no right of return can be asserted.
12 Notice of defects / warranty
The goods must be inspected immediately upon receipt and recognizable defects must be reported in writing within 5 days of receipt of the goods.
In the event of defects in the goods, Jollyknits is entitled at its discretion to remedy the defect, supply a replacement, grant a price reduction or rescind the contract by returning the service already received from Jollyknits. Excluded from the warranty are defects resulting from natural wear and tear, improper use, excessive use and other reasons for which Jollyknits is not responsible.
Warranty claims shall expire one year after delivery of the goods, even if the purchaser discovers the defect at a later date.
13 Place of performance / applicable law / place of jurisdiction
The place of performance for deliveries / services is Winterthur CH. Swiss law shall apply to all disputes between the contractual partner and Jollyknits. The place of jurisdiction is Winterthur Switzerland.
14 Amendments
We reserve the right to amend these GTC at any time and without prior notice.
